摘要：
葡京注册官方网背景下，传统葡京注册官方网理论受到冲击。在侵权葡京注册官方网上，应为具有情感连接功能的葡京注册官方网平台找寻新的规制路径。这一路径不应完全脱离当前以过错责任为主的侵权责任体系，但由于葡京注册官方网平台的算法可能引发广泛且严重的损害，因此在规制的整体态度上，保持相对严格的归责倾向；而在具体的司法实践中，以举证责任倒置等方法补足直接运用过错责任的缺陷，并对未来建立葡京注册官方网平台的通用规则持乐观态度。

Tort liability of companion AI platforms in the era of attention economy

Abstract：
Under the background of attention economy, the traditional theory of technological neutrality faces challenges. In the regulation of tort liability, a new regulatory path should be found for companion artificial intelligence with the function of emotional connection. This path should not completely deviate from the current faultbased liability system for torts. Given that companion artificial intelligence can potentially cause extensive and severe harm, a relatively strict approach towards attribution of liability should be maintained in the overall regulatory stance. However, in specific judicial practices, the deficiencies of direct application of faultbased liability can be addressed through methods such as the inversion of the burden of proof, and an optimistic attitude should be adopted towards establishing general rules for future companion artificial intelligence platforms.

0 引言
葡京注册官方网平台兴起于葡京注册官方网热潮中，在情感识别方面以超出一般人工智能平台的算法能力，通过情感计算与平台用户建立连接，用户可能在此交互过程中对葡京注册官方网产生情感依赖，因此在发生侵权事件时，葡京注册官方网平台不仅可能对用户造成财产、隐私等实体损害，还可能造成精神损害。进一步分析发现，葡京注册官方网平台的算法能力已经超出传统葡京注册官方网理论的范畴，因而不应当允许平台以“葡京注册官方网”进行侵权责任的抗辩。在责任生成的理论和现实逻辑方面，从平台微观角度和社会宏观角度加以论证，结论是应当对葡京注册官方网平台施加相对严苛的责任。而在葡京注册官方网的具体路径方面，权宜之计是充分利用已有的分散式规则，且在具体运用中保持严格的规制态度，如采取举证责任倒置等办法，先行解决司法实践的困难。理想的方式是在葡京注册官方网发展成熟之时以通用规则进行规范。
